TERMS & CONDITIONS OF THE ONLINE STORE “The Land of Moss” (PURCHASING POLICY)
GENERAL TERMS
The website www.thelandofmoss.com is the official website of the sole proprietorship under the name “FAKITSA MOSLAND MELINA”, trading as “The Land of Moss”, having its registered office in Kifissia, Attica, at 17C Rodopis Street, Postal Code 14561, lawfully represented.
This website, including all its subpages, is governed by these Terms of Use and the Personal Data Protection Policy (Privacy Policy), and operates as an online store (hereinafter referred to as the “e-shop”) for the sale of products. The website constitutes the exclusive property of the above sole proprietorship (hereinafter referred to as the “Business”).
The services of the e-shop are provided in accordance with this Purchasing Policy, in conjunction with the Website Terms of Use, the Personal Data Protection Policy (Privacy Policy), and the Cookies Policy, all of which are available on the website www.thelandofmoss.com and form an integral part of this Purchasing Policy.
By accessing the e-shop, each visitor must carefully read these terms. The Business reserves the right to amend these Terms of Use at any time. Visitors and users are solely responsible for periodically checking whether any modifications have been made to these Terms of Use.
Use of the e-shop after any such modification shall be deemed as acceptance of the modified Terms. In the event that the visitor/user does not accept any of these Terms, use of the e-shop is strictly prohibited.
For the purposes of these Terms, the term “Customer” refers to any user of the website who is a natural person over the age of 18, legally capable of entering into binding agreements, and who concludes a purchase contract with the Business.
PRODUCTS
The e-shop exclusively sells products designed and branded by the Business and does not sell products of third parties.
“The Land of Moss” is an online clothing store. All garments and their prints are exclusively designed by the Business, produced in Greece, and are legally protected [see Intellectual and Industrial Property Rights].
The e-shop offers a limited number of product codes, which are renewed each season.
USER PERSONAL DATA
To use the e-shop, the user/customer may either create and access a personal account (using personal credentials) or make purchases as a guest.
To create an account, you are required to provide certain personal information/data (full name, address, [alternative] shipping address, telephone number, and email address).
To place an order, whether as a registered user or as a guest, you will be asked to provide your full name, address, [alternative] shipping address, telephone number, email address, and, if you choose to pay by credit card, your card number, expiration date, and security code [CVV (Card Verification Value)].
Where required by law, the Business may also request and process your Tax Identification Number (A.F.M.) and the competent Tax Office (D.O.Y.).
By submitting your email address, you agree that all necessary communications regarding the completion of your order may be made via the provided email.

PURCHASE PROCESS
During the purchase and checkout process, the user is guided step by step through automated system prompts. Each order is electronically archived. Upon completion of the order, the user will receive an email confirming receipt of the order.
If any error occurs during order execution due to the company’s fault, the company is obliged to correct it.
In any case, prior to finalizing the order, the user will have the opportunity to review and correct it.
TRANSACTION SECURITY
For enhanced security of electronic transactions, all card payments are processed through the electronic payment platform “Nexi XPay” of Nexi Payments Greece S.A..
All data transmitted electronically by the customer, as well as their transfer between the Bank and VISA or MasterCard, are encrypted using TLS 1.2 encryption protocol with 128-bit Secure Sockets Layer (SSL) encryption.
Encryption is a method of encoding information until it reaches its intended recipient, who will be able to decode it using the appropriate key.
Card details are not stored anywhere; they are used only during verification and charging.
The username, password, and debit/credit card details must be kept strictly confidential under your sole responsibility.
PAYMENT METHODS
The e-shop offers the following payment options:
- By debit/credit card, charged in accordance with the regulations of the issuing bank. Accepted cards: Visa, Mastercard, Maestro, Discover and Diners.
For any other lawful methods of payment, the customer may contact the Company via the email address info@thelandofmoss.com
Cash payment or cash-on-delivery is not available.
The Company reserves the right to remove or modify any of the above payment methods, or to introduce new ones, subject to prior amendment of this document.
SHIPPING – AVAILABILITY – SHIPPING COST
Shipments are made to the address indicated by the customer, using a method selected by the company.
If the ordered product is immediately available in our warehouses and there are no reasons requiring suspension of sales, shipments within Attica shall be executed within five (5) working days, while shipments outside Attica shall be completed within seven [7] working days.
For deliveries, the Business cooperates with courier companies of its choice.
The shipping cost is borne by the customer, calculated during the completion of the order, and added to the final payable amount.
The Company shall not be liable for any additional charges that may be imposed, during the shipment of the products, by the competent Authorities of other countries upon the dispatch or receipt of parcels (including but not limited to customs duties and related fees).
Any such charges are included in the total shipping cost of the product during its final calculation and are remitted to the competent collection authorities as required by law.
PRODUCT PRICES
The prices displayed next to each product include the applicable Value Added Tax (VAT).
The listed prices do not include shipping costs. The total cost (including shipping) is confirmed upon completion of the order.
Any promotional offers or discounts will be indicated next to the initial price, and the final (discounted/promotional) price will be displayed, including VAT.
PRODUCT RETURNS
If a purchased product proves defective, the Customer has the right to return it in accordance with Articles 534 et seq. of the Greek Civil Code.
The Customer must contact the Business by email at info@thelandofmoss.com providing the order details and a brief description of the defect.
The Business will promptly process the Customer’s request within a reasonable period and will inform the Customer via email of the progress and any required steps to complete the process.
If the defective product falls within a category where returns are not generally permitted for health or hygiene reasons, the Customer must still contact the Business following the above procedure, and the Business will provide further instructions.
RIGHT OF WITHDRAWAL FROM DISTANCE CONTRACTS UNDER LAW 2251/1994 (AS AMENDED) – PRODUCT RETURNS
Pursuant to the above legislation, the Customer has the right to return products purchased from the e-shop without providing any justification, simply because they have changed their mind, within fourteen (14) days from the date of receipt.
The Customer may return the products at their own expense to the Business’s registered address.
In all cases of online orders, the Customer must first notify the Business by sending an email to info@thelandofmoss.com.
i. The withdrawal declaration must be made in writing by completing and submitting the relevant withdrawal form to info@thelandofmoss.com.
The Business must acknowledge receipt of the withdrawal declaration in writing upon receipt.
ii. The return of the product is accepted only if the Customer has previously settled any amount charged to the Business for the shipment of the product and for its return.
iii. The Customer must return the products within fourteen (14) calendar days from the day they notified the withdrawal, sending them to the address provided by the Business.
iv. Following the withdrawal, the Business must refund the amount received from the Customer. The refund will be made either to the Customer’s payment card or to a bank account for which the Customer can prove ownership.
v. The refund due to withdrawal will be completed no later than fourteen (14) working days from the date the Business was duly informed of the Customer’s withdrawal.
5.1. Exceptions to the Right of Withdrawal
The right of withdrawal under Article 4 §10 of Law 2251/1994 does not apply to:
- Products that have been used and/or unsealed (e.g., removal or cutting of tags, washing, alterations, removal from sealed packaging, or loss of packaging).
- Products manufactured according to the Customer’s customized or special order.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions of Purchase, the use of the e-shop, and any transactions conducted through it are governed by Greek Law.
Should any of these terms be deemed invalid or void, such invalidity shall not affect the validity of the remaining terms.
Any dispute arising from the use of the e-shop or relating to the interpretation or implementation of these Terms and Conditions of Purchase shall fall under the exclusive jurisdiction of the Courts of Athens, Greece.
